Welcome to AutoMate! These Terms of Service ("Terms") govern your use of the AutoMate software-as-a-service platform (the "Service"), provided by AutoMate ("we," "us," or "our"). Please read these Terms carefully before using our Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization (such as your garage), you are agreeing to these Terms for that organization and promising that you have the authority to bind that organization to these terms.

2. The Service

AutoMate provides a comprehensive management software for auto workshops, including but not limited to job card management, invoicing, inventory control, and customer relationship management. We reserve the right to modify or discontinue the Service, or any features of the Service, at any time without notice.

3. Accounts and Registration

To access the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Your Content and Data

You retain full ownership of all the data you input into the Service, including customer information, vehicle data, financial records, and inventory details ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute Your Content solely for the purpose of providing and improving the Service.

You are solely responsible for Your Content and the consequences of posting or publishing it. We do not claim ownership of Your Content, but you are responsible for ensuring you have the necessary rights to use it with our Service.

5. Subscriptions and Payment

Access to the Service requires a paid subscription. Fees are billed in advance on a recurring basis (monthly or annually) as specified in your selected plan. All payments are handled by our third-party payment processor, PayU. By providing payment information, you agree to their terms of service.

Subscriptions automatically renew at the end of each billing cycle. You may cancel your subscription at any time through your account settings. For more details, please see our Refund and Cancellation Policy.

6. Acceptable Use

You agree not to use the Service for any unlawful purpose or to engage in any activity that would violate the rights of others. You will not misuse our Service, including, without limitation, by attempting to gain unauthorized access to our systems or engaging in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us or through your account settings.

Upon termination, we will provide you with a reasonable opportunity to export Your Content. We may permanently delete Your Content after a period of 30 days following termination.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. Your use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AutoMate, its affiliates, directors, employees, or its licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this Service.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in **Mumbai, Maharashtra, India**, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
